Impact of terms and conditions

Listing unethical terms is difficult because the outcome often depends on the specific facts of the case, applicable state law, the sympathy of the court, jury or arbitrator, and the industry's perception of what customers reasonably expect. Even if the only risk is that the extension is overturned (which is usually not the only risk), any challenge to a company's business practices can lead to negative publicity.
Anyone involved in public procurement knows that contract terms are often onerous and inflexible. Previous research by the IACCM has shown that these conditions lead to significant price premiums—essentially risk aversion costs. We also know that the rigidity of contract structures can lead to costly mistakes and overruns.
